These Terms of Sale apply to purchases from Bite Sized Smiles Co. through this website. By submitting an order, you agree to these terms and to the product, price, fulfillment, cancellation, and other details shown at checkout. If an order confirmation contains different order-specific terms, the confirmation controls for that order. All listed prices are for standard colors, bulk packaging, with no edible images (except the sugar cookies). All custom decorating, individual wrapping, edible images, etc. may incur an upcharge based on the level of effort needed.

Nothing in these terms limits rights that cannot be waived under applicable law.

Bite Sized Smiles Co. offers foods made and sold under the laws and rules that apply to its operation. Available products, sales locations, delivery areas, and shipping destinations may be limited by those rules. Products are intended for the end customer and may not be resold unless Bite Sized Smiles Co. expressly agrees and the resale is lawful.

Please read the product label and any required cottage-food disclosure provided with your order. Product descriptions and photographs are provided to help you choose, but handmade items may have reasonable differences in color, decoration, size, or appearance.

Ingredient and major-allergen information is provided on the product label or with the product as required by applicable law. Products are prepared or packaged in a home or shared kitchen where allergens are present. Unless Bite Sized Smiles Co. expressly confirms otherwise in writing, no product is represented as allergen-free, and cross-contact cannot be ruled out.

If you have an allergy, intolerance, or dietary requirement, review the available information and contact Bite Sized Smiles Co. before ordering. You are responsible for deciding whether a product is suitable for you or the intended recipient. Product information is not medical advice.

An order request is not accepted until Bite Sized Smiles Co. confirms it or a deposit of 50% is successfully completed, as indicated during checkout. Products, dates, and quantities remain subject to availability. Bite Sized Smiles Co. may decline or cancel an order because of an error, unavailable ingredients or capacity, suspected fraud, an unsafe or unlawful request, or a fulfillment restriction. If Bite Sized Smiles Co. cancels a paid order, the amount charged for the canceled portion will be refunded.

You are responsible for providing accurate contact, customization, and fulfillment information and for reviewing the order before submission.

Prices are shown on the website and may change before an order is placed. The total presented at checkout includes the selected products and any displayed taxes, delivery or shipping charges, discounts, deposits, or other fees.

Payments are processed by Square as shown at checkout. You authorize them to charge the selected payment method for the amount displayed. A deposit does not reserve a date unless the checkout or order confirmation says that it does. Any remaining balance is due before delivery or pickup.

Deposit & Cancellation Policy

A 50% nonrefundable deposit is required for orders of $50 or more to reserve your order date. Your date is not considered reserved until the deposit has been received.

The deposit is applied toward your total order balance, with the remaining balance due before pickup or delivery.

Because your deposit reserves production time specifically for your order, it is nonrefundable if you cancel. If Bite Sized Smiles Co. must cancel your order, all payments you have made will be refunded in full.

For custom products, you must provide requested details and approvals by the stated deadlines. Inspiration images communicate a general direction, but do not promise an exact copy.

If an order is incorrect, damaged, or appears unsafe, do not consume the affected item and contact Bite Sized Smiles Co. promptly using the order-confirmation details.

Free pickup is available by appointment at our Fishers, Indiana location.

We offer free delivery within 10 miles of Fishers.

Need delivery a little farther away? Delivery beyond 10 miles may be available for an additional fee based on your location. Just ask when placing your order—we're happy to see what we can do!

0–10 miles: Free
10.1–20: $10
20.1–30: $20

📦 Shipping

Most of our treats are available for local pickup or delivery only to ensure they arrive fresh and looking their best.

College Care Packages are the exception and can be shipped within Indiana. Shipping charges are included in the package prices.

If you create an account, you are responsible for keeping your sign-in information secure and for activity under the account. Contact us if you believe the account has been used without permission.

You agree to receive electronic order records and transactional communications at the contact information you provide. Marketing email or text messages require the consent described when you sign up and can be stopped using the unsubscribe or opt-out instructions in the message.

Bite Sized Smiles Co. is responsible for products and remedies to the extent required by applicable law. To the fullest extent the law permits, Bite Sized Smiles Co. is not responsible for losses caused by inaccurate customer instructions, failure to collect or receive an order, improper handling after fulfillment, unauthorized resale, or events outside reasonable control.

If you have a concern, contact Bite Sized Smiles Co. promptly using the information on this website or in your order confirmation so the parties can try to resolve it. These terms are governed by the laws that apply to the sale. If one provision cannot be enforced, the remaining provisions continue to apply.
